PRIVACY AND COOKIES POLICY OF WWW.BI-POLSKA.PL

I. GENERAL PROVISIONS

1. This document (hereinafter referred to as the "Privacy Policy") defines the rules of processing by Develia Vita sp. z o.o. (formerly Bouygues Immobilier Polska sp. z o.o.), with its registered office in Warsaw, at Rondo ONZ 1, “Rondo 1” building, 24th floor, 00-124 Warsaw, entered in the Register of Entrepreneurs of the National Court Register, whose registration files are kept by the District Court for the City of Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS no: 0000023187, NIP: 5272321100, with the share capital: PLN 38,000,000.00, having the status of a large entrepreneur within the meaning of Article 4(6) of the Law on Prevention of Excessive Delays in Transactions of 8 March 2013 (hereinafter the "Data Controller" or "BIP") of the personal data of users of the website maintained by BIP at  www.bi-polska.pl (hereinafter the "Website"), on social networks and, in the case of registration, of customers using the Customer Panel

2. Personal data of users of the Website and those using the Customer Panel are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (hereinafter the "GDPR").

3. Capitalized terms used in the Privacy Policy shall have the meaning given to them in the regulations of the www.bi-polska.pl website (hereinafter the "Website Regulations").

II. PRINCIPLES OF PROCESSING PERSONAL DATA OF THE USERS OF THE WEBSITE OR THE CUSTOMER PANEL BY BIP

1. Through the Website or the Customer Panel, BIP may collect personal data of the Users of the Website or the Customer Panel.

2. BIP becomes the controller of your personal data when you:

a) use the functionality of the Website or

b) register in the Customer Panel.

2. The Data Controller obtains your personal data in the following ways:

a) Users of the Website - only browsing of the Website

BIP analyses your behaviour on the Website, including monitoring and collecting information about your activity on the Website (e.g., frequency, tabs viewed), for use in evaluating and implementing its own marketing efforts.

For more information about the acquisition and processing of personal data via cookies, see Section V.

b) Users of the Website - completion and submission of the Contact Form

i. Using the Contact Form on the Website, the User can send the following personal information to BIP: name, phone number, e-mail address. The User's decision to complete the Contact Form and provide the personal information indicated above is voluntary and up to the User. If the User provides other data before or after completing the Contact Form, this data will be attributed to the relevant User.

ii. Personal data provided by the User in the Contact Form will be used by BIP to send a response to the User's inquiry.

iii. In addition, the User may consent to the processing of the provided personal data for marketing purposes by BIP and to receive commercial information from BIP electronically. For more information about the acquisition and processing of personal data via cookies, see Section V.

c) Users of the Customer Panel

The BIP customers who have entered into an agreement with BIP may register in the Customer Panel under the terms and to the extent consistent with its regulations.

III. INFORMATION OBLIGATION

1. The controller of your personal data is Develia Vita Sp. z o.o., Rondo ONZ 1, “Rondo 1” building, 00-124 Warsaw.

2. The Data Controller can be contacted as follows:

3. The Data Controller has appointed the following Data Protection Supervisor: Agata Klimek-Cortinovis, e-mail: iod@bi-polska.pl.

4. What personal data does the Data Controller process, for what purposes and on what basis does the Data Controller use your personal data?

a) Users of the Website who browse the Website's pages

BIP processes the following data of Website Users:

a) IP address of the end device, only to ensure the security of the system's operation (e.g., for efficient blocking in case of DDoS attacks),

b) a unique User identifier generated before an entity acting on behalf of the Controller and stored in a cookie for the purpose of collecting statistical data that helps analyse how users use the Website,

c) a unique User identifier generated by an entity acting on behalf of the Data Controller and stored in a cookie for the purpose of session identification, whereby all changes to the site or selected items or data are remembered by the site (e.g., when moving from page to page, the User does not have to indicate each time that he or she has read the cookie and privacy policy).

This information is collected for the proper operation of the Website, and in particular for security purposes, including IT security, and for use by BIP to evaluate and carry out its own marketing activities.

The legal basis for data processing is the necessity of its processing for the realization of the Data Controller's legitimate interest (Article 6(1)(f) of the GDPR); the Data Controller's legitimate interest is to ensure the proper functioning of the Website, including the development of the Website's functionality; and the legal basis for profiling is the User's consent expressed by accepting the browser's settings for the use of cookies (Article 6(1)(a) of the GDPR).

b) Users of the Website who complete and submit the Contact Form to BIP

BIP processes the data provided by Website Users who complete and send to BIP a completed Contact Form, in order to prepare a response to the questions asked, the matter reported, and to handle the conduct of correspondence with you. Providing data in the Contact Form is voluntary, but necessary for BIP to respond.

Failure to provide data will result in BIP's inability to process your data for the purpose of responding to the inquiry you send.

The legal basis for processing the personal data you provide is the necessity of its processing for the realization of the Data Controller's legitimate interest (Article 6(1)(f) of the GDPR). The Data Controller's legitimate interest is to be able to answer a question or a reported issue and to handle correspondence.

In addition, the information on the processing of personal data listed in a) above also applies to Users who submit a Contact Form to BIP.

c) Users of the Website who complete and submit to BIP a completed Contact Form and allow BIP to send them marketing information

BIP processes the data provided by Website Users who fill out and send to BIP a completed Contact Form and give their consent to send marketing information in order to send you marketing information regarding investments made by BIP and services offered by BIP.

The legal basis for data processing is your consent (Article 6(1)(a) of the GDPR). Failure to provide data will result in the Company's inability to process your data for the purpose of marketing products and services offered by the Company.

In addition, the information on the processing of personal data listed in a) and b) above also applies to Users who submit a Contact Form to BIP and allow BIP to send them marketing information.

d) Users of the Customer Panel

Data of those of you who use the Customer Panel are processed by BIP for the purposes and to the extent specified in the Regulations of the Customer Panel.

Providing personal data for the use of the Customer Panel is not a statutory requirement, but it is necessary for the execution of the agreement for the provision of electronic services.

The legal basis for the processing of the personal data you have provided is the execution of the concluded agreement (Article 6(1)(b) of the GDPR).

In addition, the information on the processing of personal data listed in a) above also applies to persons using the Customer Panel.

e) Notwithstanding items a) - d) above, the data of Website Users may be processed for the purpose of establishing, investigating or defending against claims related to the use of the Website.

The legal basis for data processing is the necessity of the processing for the realization of the Data Controller's legitimate interest (Article 6(1)(f) of the GDPR); the Data Controller's legitimate interest is to protect against claims related to the use of the Website.

f) Data of social network users

The Data Controller maintains profiles on the following social networks:

Profiles are maintained for the purpose of contacting their users and presenting content prepared by the Data Controller on these social networks and promoting its own activities, as well as for analytical and statistical purposes, which constitutes the Data Controller's legitimate interest in enabling contact with users of the social networks, promoting its own activities and providing information about them. Through the social networks, the Data Controller may also conduct contests in which the user participates voluntarily. The Data Controller processes personal data of social networks users when they visit the Data Controller's profiles or interact with them (likes, comments, sent messages). If a social network user likes a post or comments on it, he or she acknowledges that this is visible to other users. The personal data of social network users are processed until they object to further processing by withdrawing their like of an entry or deleting a comment on an entry and then for the period required by the obligations imposed by law or until the expiration of the statute of limitations for possible claims related to the purposes of processing.

Social networks have their own privacy policies, regulations and data processing rules, which bind their users and with which we are obliged to comply. If you are a user of such a social network, the processing of your personal data is also subject to such regulations and policies, and you can exercise your rights pursuant to them.

5. Does the Data Controller share your data with other entities ?

Yes, BIP shares your data with other entities. The recipients of your personal data may be:

a) marketing agencies, IT service providers and other entities to which the Company entrusts data processing in connection with its operations, including entities in the capital group to which BIP belongs,

b) authorized bodies, if such an obligation arises from mandatory provisions of law.

Personal data processed by BIP may exceptionally, only to the extent necessary, be transferred to BIP's processing partners outside the European Economic Area, e.g., in connection with the provision of IT services, including in the cloud, by these entities to BIP. The security of personal data is ensured by the appropriate safeguards applied by BIP, including standard contractual clauses approved by the European Commission.

6. How long do we process your personal data?

Your personal data will be processed by BIP:

a) for the period necessary for BIP to respond and provide information in accordance with its correspondence with you,

b) with regard to the processing of personal data based on your consent, your personal data will be processed until you revoke your consent,

c) for a period no longer than the limitation periods under the applicable provisions of Polish law to the extent that your personal data will be processed for the purpose of establishing, investigating or defending against claims,

d) in terms of session cookies for a period of time until they are deleted from your browser, and in terms of permanent cookies - such cookies remain in your browser until they expire or until you delete them from your browser,

e) with regard to the processing of personal data of persons using the Customer Panel - until the termination or expiration of the agreement on the use of the Customer Panel, in accordance with its Regulations.

7. What rights do you have?

You have the right to access personal data concerning them and the right to request the rectification of such data, their deletion or restriction of their processing.

To the extent that the basis for the processing of your personal data is the premise of consent, you have the right to portability of your personal data and to revoke at any time your consent to the processing of personal data without affecting the lawfulness of the processing performed on the basis of consent before revocation.

To the extent that the basis for the processing of your personal data is the premise of the Data Controller's legitimate interest, you have the right to object to the processing of your personal data.

The rights referred to above can be exercised by contacting BIP in the manner specified in Section. III paragraph 2 above.

You also have the right to lodge a complaint with the supervisory authority dealing with personal data protection, i.e., the President of the Office for the Protection of Personal Data.

IV. PROCESSING OF PERSONAL DATA OF CONTRACTORS AND REPRESENTATIVES OF CONTRACTORS

1. BIP is the controller of personal data of BIP contractors and persons representing contractors and participating in the execution of agreements. The Data Controller can be contacted by regular mail at the address of the registered office and through the Data Protection Officer, Agata Klimek-Cortinovis, at the following e-mail address:  iod@bi-polska.pl.

2. In connection with the application of the GDPR, we would like to inform you that BIP, in the course of its business, may process personal data (in particular, contact data) of contractors and prospective contractors, employees, legal representatives, and representatives and agents of contractors. BIP can also obtain additional information from public sources, such as business and professional registers maintained under the law (e.g., CEIDG - Central Register and Information on Business Activity, KRS - National Court Register).

3. The collected personal data will be processed by BIP:

a. pursuant to Article 6(1)(b) of the GDPR, when the processing of such data is necessary for the performance of the agreement and the fulfilment of obligations under the agreement (e.g., full name, contact and registration details). Provision of data necessary for the conclusion of the agreement or its execution and settlement is mandatory. For this purpose, BIP may process personal data during the term of the agreement;

b. pursuant to Article 6(1)(c) of the GDPR, when the processing of such data will be necessary for the fulfilment of BIP's legal obligations. Provision of data is mandatory, and the obligation arises from the law. For this purpose, BIP may store data for the duration of such obligation (e.g., data contained in invoices and documents confirming activities and transactions undertaken);

c. for the pursuit of the legitimate interests of BIP or third parties, where such interests override the interests or fundamental rights and freedoms of data subjects, pursuant to Article 6(1)(f) of the GDPR. Such legitimate interests include, for example, verification of the financial and economic credibility of the counterparty, prevention of corrupt practices, establishment, investigation and protection of claims arising from the business, and protection against such claims - over a period of time that takes into account the expiration periods of each claim.

4. BIP may disclose personal information to:

a. entities and persons acting for and on behalf of BIP;

b. state authorities, acting in the course of their investigations;

c. entities in the capital group to which BIP belongs;

d. other entities, insofar as this is necessary for the performance of actions taken at the request of the data subject.

5. Personal data processed by BIP may exceptionally, only to the extent necessary, be transferred to BIP's processing partners outside the European Economic Area, e.g., in connection with the provision of IT services, including in the cloud, by these entities to BIP. The security of personal data is ensured by the appropriate safeguards applied by BIP, including standard contractual clauses approved by the European Commission.

6. Each person whose data is processed by BIP has the right to access the content of his or her data, to request rectification, and - within the limits of the law - the right to request erasure, limitation of processing, to object, and the right to data portability. To exercise your rights, contact BIP's Data Protection Officer.

7. Each person has the right to lodge a complaint with the President of the Office for Personal Data Protection when he or she considers that the processing of his or her personal data is unlawful.

V. COOKIE POLICY

1. BIP uses cookies on the Website in order to adapt the Website to the Users' needs and for statistical, advertising and functional purposes.

2. Cookies are IT data, in particular text files, which are stored on the User's terminal equipment and are intended for use on the Website. The next time you connect to the Website, cookies may be read from your computer and used to customize the Website to your remembered preferences and for statistical and advertising purposes.

3. BIP uses cookies for the following purposes:

a) provision of services,

b) adaptation of the content of the Website to the User's preferences and optimization of its use, e.g., cookies allow, in particular, to recognize the User's device and appropriately display the website adapted to his/her individual needs,

c) creation of statistics that help to understand how Users use the Website, which allows to improve its structure and content,

d) presentation of advertisements, among other things, in a manner that takes into account the User's interests.

4. Subject to the provisions of paragraph 6 below, the entity placing cookies on the User's terminal equipment and accessing them is BIP and entities acting on its behalf in connection with the operation of the Website.

The following categories of cookies are used within the Website:

a) cookies related to the operation of the site, which allow remembering User preferences, such as the language of the Website, housing search criteria, Website settings,

b) advertising cookies set by BIP's advertising partners to enable the display of relevant ads on their websites. These files allow advertisements to be more relevant to Users' interests,

c) statistical cookies that help analyse how Users use the Website. This information helps to better understand User behaviour and optimize the Website.

5. The Website uses Google Analytics cookies. These are files used by Google to create statistics and reports on the functioning of the Website, in order to analyse how the User uses the Website. Detailed information on the scope and principles of data collection in connection with this service can be found at the following link: https://www.google.com/intl/pl/policies/privacy/partners. Social networks also employ various solutions and tools used for analytical purposes. For details in this regard, please refer to the Privacy Policy of the respective partner.

6. External cookies are used for:

a) collecting statistical data through analytical tools,

b) displaying advertisements on BIP's advertising partners' websites, which may be more relevant to Users' interests. Data from external cookies allow us to display advertisements to the right audience and also to create groups of similar audiences and to analyse the user's behaviour after clicking on an advertisement on both the partner site and the BIP site,

c) providing users with appropriate conditions for the use of services provided by BIP’s partners (including advertising) (e.g., displaying the aspect ratio and size of the User's screen and windows on the device, information on logging in the partner's website, correct display of information in the partner’s website),

d) collecting statistics on the number of video views or the video player settings for videos and playlists uploaded to the site from YouTube,

e) correct display of BIP partners' tools on the Website (e.g., Google Maps),

f) collecting data on application performance and user interaction with the application through analytical tools in the case of 3D Estate interactive mock-ups.

7. Most third-party cookies are stored in the domains of the respective entities. More information about them is available on their websites.

8. The web browsing software (web browser) allows by default to store cookies on the User's terminal device.

9. Users can change their cookie settings at any time. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the settings of your web browser or inform about their placement on your device each time. Detailed information about the possibility and methods of handling cookies is available in the settings of your software (web browser).

11. Restrictions on the use of cookies may affect some of the functionality available on the Website.

12. Regardless of cookies, the Website automatically records certain information in server logs every time you visit. The logs contain the following information:

a) IP address of the end device;

b) the date and time of access to the Website;

c) information about the browser and operating system used by the User.

13. The information referred to in paragraph 12 above is used, in particular, to manage the Website, analyse possible security violations on the Website, and for statistical purposes.

VI. FINAL PROVISIONS

BIP reserves the right to change the provisions of the Privacy Policy. BIP will notify Users of any change to the Privacy Policy within 7 days prior to the effective date of such changes by publishing the consolidated text of the Privacy Policy on the Website. In the event of a change to the Privacy Policy, continued use of the Website is a statement of intent by the User signifying acceptance of the changes to the Privacy Policy. This version of the Privacy Policy takes effect from 25 April 2024.
